Please read these terms carefully before using the Website or contracting our services. By browsing the Website or placing an order, you accept these Conditions.

1. Who we are and scope of service

Website and services owner: GENELINK, S.L. (“Vivabioma”).

Provision of service: within the European Economic Area, mainly from Spain, with support laboratories currently located in Denmark and/or Spain.

Languages: in case of discrepancy between versions in different languages, the Spanish version shall prevail.

2. Acceptance, changes, languages and archiving

Accessing, browsing and/or purchasing on the Website implies acceptance of these Conditions.

We may update them by publishing a new version and we will maintain an accessible history on a durable medium.

If the change affects economic obligations (e.g., price or subscription renewal), we will notify you at least 15 days in advance by a means you can store (email or other durable medium).

Contract languages and correction of errors: The process can be carried out in the available languages indicated on the Website. Before paying, you will see an order summary and will be able to correct errors (shipping, billing, products). After purchase, we will send the contractual summary and these Conditions on a durable medium (email).

3. Use of the Website and responsibility

The user agrees to:

- provide true and up-to-date data;

- not introduce illegal content or malicious code;

- protect their credentials and, when available, activate two-step authentication;

- respect intellectual and industrial property rights;

- not impersonate other people or perform advertising without permission.

We do not guarantee continuous availability or the absence of errors. Except for willful misconduct or gross negligence, our total liability for damages related to the Website or the service shall not exceed the price paid for the corresponding service (taxes excluded) and will not cover indirect losses (loss of profit, loss of opportunities). Exclusions: nothing limits or excludes liability for death or personal injury due to negligence, willful misconduct or gross negligenceinalienable rights of the consumer or breach of essential obligations when it causes direct and foreseeable damage.

4. Intellectual and industrial property

Texts, images, designs, software, algorithms, databases and interpreted reports are the property of Vivabioma or third parties with a license.

You are the owner of the data protection rights over your personal information and retain access control and portability over your raw data according to the law.

Reproduction, distribution or public communication of Vivabioma contents without prior written authorization is prohibited.

5. Links

You may link to our home page without creating frames, without using our trademarks without permission and without suggesting sponsorship if none exists.

We may include links to third-party sites, whose contents and policies we do not control or guarantee.

6. Data protection and cookies

The processing of your data, including microbiome data, is governed by the Privacy Policy, which is part of these Conditions.

The Website uses cookies according to the Cookies Policy. Non-essential ones require your consent and can be configured in the preference panel.

7. Products and functional scope

Starter

-Includes basic analysis of microbial biodiversity, intestinal well-being index (Gut Score), the functioning of the gut-brain axis (GABA and indoles) and metabolism of essential nutrients.

-Provides an estimate of biological age based on the microbial ecosystem. Does not include advanced reports on pathologies, hormonal health or systemic protection.

Advanced

-Includes all the functionalities of Starter and adds specific functional health modules: hormonal health (estrobolome), mouth-gut connection, evaluation of inflammation and risk of SIBO, and histamine intolerance.

-Incorporates indicators of systemic protection (cardiovascular and hepatic).

-Based on Shotgun metagenomic sequencing technology, which allows resolution at species and strain level.

Ultra

-Represents the most comprehensive analysis experience through high-depth Shotgun sequencing.

-Includes exclusive Machine Learning algorithms for the prediction of relative risk of pathologies (such as Type 2 Diabetes or Crohn's) and the analysis of the resistome (antibiotic resistance genes).

-Provides a personalized action plan through Prebiotic Matching (superfoods) and precision probiotic recommendations based on functional traits.

7.1 Requirements for contracting and activation

Contracting limited to those over 18 years of age.

In the case of minors or persons without capacity, the legal representative contracts and consents with documentary accreditation.

We recommend activating and sending the sample within 12 months after purchase.

The sample must be sent from the same country of purchase; if not possible, contact us first (costs or restrictions may apply).

7.2 Purchase process and confirmation

Before finalizing the purchase, we will inform you of all phases and how to correct errors. After payment, you will receive a confirmation email with the order summary, instructions and kit activation.

7.3 Delivery of results

Delivery is carried out exclusively in digital format within your customer area. Terms are indicative and depend on the volume of samples, quality controls and technical capacity.

8. Right of withdrawal and returns (only EU consumers)

You have 14 calendar days to withdraw.

Legal exceptions:

Unsealed hygiene or health goods (e.g., stool kits) cannot be returned.

Services fully provided with your consent during the withdrawal period.

Digital content not supplied on a physical medium whose access has been initiated with your consent.

If the kit is still sealed, contact support and send it back in a maximum of 14 days from when you communicate the withdrawal. We will refund the payments (including, when applicable, standard shipping) in a maximum of 14 days. We may withhold the refund until the kit or proof of shipment is received. Except for product defects, return costs are borne by the customer. The refund is made by the same means of payment, unless otherwise agreed.

9. Shipping, logistics and customs

9.1 Deliveries and Collection Points (Parcel Shops)

Vivabioma undertakes to manage the shipment to the address provided by the customer. However, if for logistical reasons or absence the courier company deposits the order at a nearby collection point (Access Point, Parcel Shop or similar), it will be the exclusive responsibility of the customer to go and collect it within the periods stipulated by the carrier. Vivabioma will not assume responsibility or additional costs for orders that are not collected by the customer at said convenience points.

9.2 Correct use of the kit and shipping protocol

It is the customer's responsibility to strictly follow the instructions for use and packaging included in the kit and detailed on our website. For the sample to be processed correctly, it must be sent using exclusively the official return label generated after registration on our platform.

In the event that the kit is sent incorrectly, without following the packaging instructions or without using our authorized shipping label, Vivabioma will not be responsible for the loss or unfeasibility of the sample. In these cases, free replacement kits will not be sent. The customer must contact our Customer Service, where they can request an exclusive discount code for the purchase of a new kit if they wish to repeat the process.

9.3 Accidental damage or incorrect handling of material

If during the sample collection process the material suffers any accidental damage by the customer (for example: the swab falls to the floor, breaks, is contaminated or any component is lost), the customer must contact our Customer Service team.

In these cases, a free replacement kit will not be sent. However, we will provide the customer with a special discount coupon whose amount will cover only the cost of the replacement material and shipping costs, thus allowing the customer to complete their microbiome test without having to pay for the analysis service again.

9.4 Customs and International

We offer included round-trip shipping when the sample is returned from the same country of purchase. In international shipments, taxes or customs duties may be generated at the expense of the recipient; the recipient may act as an importer before their local authority. Territorial restrictions may exist due to local regulations which will be informed during the purchase.

9 bis. Warranties and after-sales service

The physical kits are covered by the applicable legal guarantee of conformity. In Spain, the legal guarantee is 3 years from delivery; in other EU Member States, at least the legal guarantee established by their national regulations applies. For digital content or services, we comply with the rules of conformity and updates of Directives (EU) 2019/770 and 2019/771, according to local transposition. This guarantee does not affect your legal rights as a consumer or any additional commercial guarantee.

10. Professional Access and regulatory notices

If you share your results with a healthcare professional through our platform:

- Vivabioma is responsible for the functioning of the platform; the professional is responsible for the use they make of that information in their practice.

- Any clinical decision must be confirmed in an accredited healthcare setting (e.g., laboratory with quality certification).

USA: Vivabioma is not HIPAA-covered entity and does not sign Business Associate Agreements (BAA).

11. Essential scientific limitations and warnings

Our reports are of an informative and educational nature and are not medical device intended for in vitro diagnosis, nor do they replace medical judgment.

We recommend independent advice  in case of relevant doubts.

12. Permitted use and prohibitions

The use of the reports and content is personal, private and non-commercial. Prohibited acts include, among others:

- reproduction or distribution of reports without permission;

reverse engineering and mass extraction of data or metadata;

- development of competing products/services using our data or reports;

- use for forensic, legal filiation, labor or insurance purposes.

13. Other legal issues

Assignment and subcontracting: we may work with providers who comply with applicable regulations.

Severability: if any clause is void, the rest remains in force.

No waiver: if we do not exercise a right at one point, it does not imply a future waiver.

Force majeure: no party will be liable if a breach is due to events beyond its reasonable control.

Alternative dispute resolution (EU): the ODR Platform stopped accepting new claims on 03/20/2025 and closed on 07/20/2025. As alternatives, you can go to Consumer Arbitration Boards or mediation/arbitration bodies in your country, or to the competent European Consumer Center. We will maintain updated ADR channels on the Web.

15. Applicable law and competent courts

These Conditions are governed by Spanish law. For any dispute, and without prejudice to the inalienable rights of the consumer according to their domicile, the parties submit to the Courts and Tribunals of Valencia (Spain).
